The game of Texas Hold 'Em is, oddly enough, not legal (at least not in public raked games) in the state that gave the game its name. The rash of arrests of raked games and tournaments in several cities in Texas proves this beyond a doubt...
Although, I definitely agree with making poker legal in all states, using pokertek tables in the cardrooms would be stupid. The entire point of playing poker in a card room is to have the whole physical aspect of holding an pushing the chips, raking pots and stacking cheques and physically looking at your hole cards. The only positive would be that you wouldn't have a dealer to tip but, if you get dealers to deal in a cardroom, you're actually providing jobs and a new workforce, even if it is a small one. Get some surveillance to watch them if there are any indications of cheating. However, if you vy to keep the rooms small, say 20 tables max, you could have a relatively small staff and if they're well trained there would be no problems with cheating or collusion...As long as the rules were enforced.
I would love to see legalization of poker in Texas. Right now I have to drive 90 miles one way to Winstar Casino in Oklahoma. I DO NOT want to play on electronic tables. Thay had those at Winstar and finley took them out becuse no one wanted to play them. It's just not the same when you cannot hold the cards and shuffel the chips. And what is this about "reporting of the state's cut in taxes which, according to the way the bill is written, has to be done daily by 5PM." Why can't we have poker rooms and the law in Texas just like thay have in California. I can see Texas having some real nice and big rooms like the Commarce Casino in L.A. If we just had the right laws.
