I have done a lot of research, and I still cannot seem to find the clear answer to this. My conclustion is that it's illegal for financial institutions to fund US poker players online, but it isnt illegal for us to actually play. any feedback on this?

Not really. Neteller was charged for violations of the Wire Act over sports betting.
Recent Congressional Hearings and DOJ testimony show for the individual playing on-line is not illegal unless the US citizen lives in one of a few States where the State Legislature expressly prohibits on-line poker. At the Federal Level there is no law that has a punishment for an individual.
Realistically it is very hard to easily deposit and even harder to withdraw any winnings.
You get to pay at least 5% to deposit and hope you can cash a check if the site ever sends you one.

This is only my observation but, in the few states that have Legislation making it illegal to gamble online, in some instances, it's still very gray. I've read some and as I read it relates more toward the business of online gambling rather than the act or participation in a game. I look forward to the day when US players can Log-in without worry.

Pessimistic Optimism is the best I can muster.
