Post Reply
Phil Ivey

On Monday evening, PokerNews brought you breaking news that Phil Ivey would not be playing the 2011 World Series of Poker. Not only that, he filed a lawsuit against Tiltware, the software and marketing company for Full Tilt Poker. On Wednesday, Tiltware released a statement in response to Ivey’s actions.

Before getting to the statement, we should probably let you know that Ivey has retained Las Vegas lawyer David Z. Chesnoff for this lawsuit, which was filed in the District Court of Clark County, Nevada, and can be viewed in its entirety on Scribed. Tonight’s Nightly Turbo did a decent job...

Wow, talk about the pot calling the kettle black. Regardless of any speculation of Phil Ivey's intentions behind his lawsuit, it is without a single doubt that Tiltware are total pirates when it comes to this situation and could give a shit less about their customers. The facts: They have millions of dollars of other people's money and they're not giving in back. No speculation about that.

"Mr. Ivey appears to have timed his lawsuit to thwart pending deals with several parties that would put money back in players’ pockets..."

BWAAAAAHHH-HA-HA-HA-HA-HA-HA!
Good one, Howard.

Ivey looks out for Ivey: expected. Tiltware/FT making BS excuses for never returning players bankrolls: standard. All trying to manipulate players perceptions to suit their agendas: inevitable.

The saddest thing is that if it goes to court FT/TiltWear will win cuzz they gut more muscle(all of the pro players will be on their side if they wanna stay patched up).And i respect Ivey sooooo much for doing this but he will end up with the thick end of this (and he is known for being mysterious and quiet, everybody is going to attack him) and that just makes me sad.

indeed the timing looks strategic...
does it really matter if it is for himself or not? shouldnt the point be that hes wrong or right? wth is that statement? they simply tryied to degenerate his image, theres nothing in the statement about actions taken or law related, it ws just a threat.. looks like it was written by a 15 yo jeallows boy.
i also think that everyone in the Us with locked money into FTP should fill a lawsuit against them, standing pat wont help.
looking forward to see ivey with pokerstars patch Big Grin

The aggressive & insulting tone of the statement is unfortunate and a clear sign that this issue is not in the hands of a professional. Normally a statement is much more general, avoids libelous statements, and it really is enough to say that the lawsuit is without merit if they feel that is the case. Making a case personal just makes a settlement (which is normally likely) harder when discovery is under way. The way this response reads is "This is the way we treat FTP Pros when there is a disagreement" and this does *not* help the FTP reputation at a time that they need all the help they can get while FTP gets through this time.

One posted comment did raise a very real point ... this lawsuit does make it more difficult for FTP to address the one thing that has to happen: mobilizing money to reimburse the players. Phil Ivey is a smart guy and has to know that his lawsuit makes it virtually impossible for FTP to get the investment that FTP says it needs.

So although Phil Ivey is a great guy etc etc ... the reality is that his actions are indirectly shafting FTP efforts to get money to the players pockets. With all due respect to Phil Ivey this is reality.

FullTiltPoker very clearly have not been running their business model very well or everyone would be paid by now so the operational executive management get 100% of the blame for bozo business practices. I hope that despite this lawsuit FTP can mobilize the cash to pay back everyone so that they can concentrate on the DOJ action and of course Phil Ivey's lawsuit ... add to that list a new Executive management team because clearly they are out of their depth.

@Pokerboy: tough to stay "patched up" when your $4 billion dollar company (this is what FTP was valued at before all of this mess) is pretty much in the shitter and your owner is begging to sell a 50% stake for $200million.

End of the day, you gotta question Ivey's motives here. I like the guy, but doing something like this certainly makes it seem like he's doing this for his own aggrandizement.

I can say from legal experience that lawsuits like this are brought to do several things. One legitamize one's case against another. Also to in effect try and make someone who is in the spotlight look better than they seem. Another is to solidify solid ground for other cases that might be looming. Yet another is if one is going to seek bankruptcy protection. I truly can't believe that Phil Ivey would have no idea what this company has been doing! Especially if he is a major shareholder. My opinion is that He, Howard and Chris all know full well what is and has been going on. If you had no idea why would you be the face of such a company? We have all been getting fleeced. If you read all of the DOJ charges. One of the charges is that they (FTP) had set up superuser accounts for the bankers who would win tourneys no matter what cards they played in order to get their pay off $$. I would love to see the evidence to such claims be aired out publically where we can all see. After all it is our $ that is in jeapordy. I have been playing live poker for over 10 years and have only ever lost quads over quads once. Yet in a 3 year period I lost quads over 5 times on tilt. Why is that? It was not too many years ago that UB and AP got busted for the cheating scandal. It is sad. What we need is for the govt to hurry up and give us a fair and honest solution that we can all have fun and play poker on. Good luck with that LOL

If Ivey was REALLY looking out for the unpaid players he would have started a CLASS ACTION suit instead of merely trying to get out of his noncompetition agreement
